Terms and conditions of the prize draw

Where the Organiser’s business partner also participates as a co-organiser of the prize draw, the latter shall provide the prizes and conduct the prize draw, and the Organiser shall conduct the prize draw on its own social media channels as set out in the prize draw text. Terms and conditions of participation
The prize draw is open to persons of legal age with permanent or temporary residence in the Republic of Slovenia. Minors are not allowed to participate in the prize draw unless specifically stated in the description of the prize draw on the social media profile. Where permitted, minors (under 18 years of age) must have the prior written consent of their parents or legal guardians to participate in the prize draw. The prize draw is open to social media users, unless otherwise provided for in the prize draw text. Participation in the prize draw is not conditional on the purchase of the Organiser’s products or services and is free of charge. Entrants are responsible for all costs incurred in entering the prize draw. The costs of participation include, but are not limited to, the cost of access to the Internet;
the cost of downloading data from the Internet. The prize draw is open to everyone. Each individual may enter only once per prize draw. Sweepstakes progress
A detailed presentation and the progress of the Sweepstakes can be found on the Website and/or the Social Media Profile.

Rules of the prize draw
The start and end date of the prize draw is published on the social media profile where the prize draw takes place. By participating in the Sweepstakes, the entrant is deemed to accept these General Sweepstakes Terms and Conditions and the terms and conditions published on the Website and/or the Social Media Profile. In the event of providing incomplete, incorrect or false information (email address or information referred to in Article 8.3.3 of the General Terms and Conditions of the Sweepstakes), the Organiser reserves the right to refuse the Participant’s participation in the Sweepstakes or to exclude the Participant from the Sweepstakes. The Participant shall forfeit the right to the Prize if the Organiser determines that:
the Participant has not complied with the Conditions of Participation;
the Participant has breached the Rules and Conditions of Participation in the Sweepstakes;
the Participant is unwilling to comply with these Terms and Conditions or the Specific Terms and Conditions published on the Website and/or the Social Media Profile, or has failed to comply with them in a timely manner;
in the case of Entries: if the Entry is inadequate or inappropriate in any way whatsoever; in the case of Entries: if the Entry is inadequate in any way. In the event that an Entrant forfeits his/her right to a prize, the Organiser shall decide whether or not to award the prize to someone else. If the terms and conditions of the prize draw make participation in the prize draw conditional upon the entrant submitting sketches, drawings, photographs, videos or other copyright material, the entrant warrants that by submitting the material to the Promoter, the entrant owns all material copyright in the material and hereby assigns all such copyright to the Promoter in full, once and for all, in all cases. By submitting the material referred to in the previous paragraph of this Article, the participant gives his/her irrevocable consent to the publication, exhibition, printing, distribution, etc., in part or in full, without any restrictions on transformation or processing of the material, in any media (print media, websites, advertising editions or other social media) of the organiser or the co-organiser of the prize draw, without any right to compensation or remuneration. You also waive the right to review, approve, object to any use of the material, editorial choice or appearance of the material. In the event that an entrant is drawn or selected as a prize winner, by accepting the prize, the entrant agrees to cooperate with the Organiser or Co-organiser in taking photographs of the prize winner for the purposes of advertising or publishing the material so obtained in any media (print media, websites, advertising editions or other social media) of the Organiser or Co-organiser of the prize draw without any right to compensation or remuneration. You also waive the right to review, approve, object to any use of the material, editorial choice or appearance of the material. Prizes
Each entrant may only receive one of the prizes. If an entrant is drawn twice or more, he/she will receive the prize for which he/she was drawn first. The type and description of the prizes are set out in the text of the prize draw on the Website and/or the Social Media Profile where the prize draw takes place. Prizes are not redeemable for any other type of prize, payable in cash or transferable to third parties. Prize Draw
Selection or.

The draw of winners is determined using the online random draw tool “Like Picker”. The organisation, execution and supervision of the prize draw and the draw of the winners is carried out by a committee composed of representatives of the Promoter and/or representatives of the Co-Promoter. The prize draw will take place on the date set out in the prize draw description on the Website and/or the Social Media Profile, but no later than 14 days after the end of the prize draw. Notification of winners
The winner will receive notification of the prize via a private message on his/her social media profile.

By participating in each prize draw, the entrant agrees to be announced as a winner on the Social Media Profile wall and tagged (“tag”) by the Promoter in the event of a prize draw. In the event that the prize draw takes place only on the Website, the participant agrees that, in the event of the prize draw, the prize winner will be announced by the Organiser on the Website on which the prize draw takes place. The list of winners will be published on the Website and/or Social Media Profile no later than three days after the prize draw. In the event that the draw is conducted by a co-organiser, the list will be published no later than ten days from the date of the draw. The results of the prize draw are final. They cannot be appealed. Claiming the prizes
The participant is entitled to claim the prize as a winner if he/she is notified of the prize by the organiser or the administrator of the Website and/or the Social Media Profile within the agreed time limit.

The prizes are subject to taxation under the Income Tax Act. The winner is liable for income tax under the Income Tax (Other Remuneration, including prizes) Act. In order to claim the prize, the prizewinner must provide the following personal data upon written request from the Organiser: name and surname, exact address of permanent residence, place of residence, tax number and tax office. The winner shall also provide a contact telephone number for the purposes of notification of the prize claim. If the prize winner fails to provide the necessary information within seven days of the date of the reminder, he/she will forfeit his/her right to the prize without any compensation. The Organiser will inform the winner in writing of the method of claiming the prize. The prize may be sent by the Organiser, at its own expense, to the address provided by the winner, or may be collected in person at the Organiser’s offices or by arrangement.
Where the prize is a delicate item (e.g. a delicate mechanism, glass packaging, packaging containing liquid, etc.) or an item which, due to its weight and/or size, is unsuitable for safe postage, the prize shall be collected by the prizewinners in person at the Organiser’s registered office.

Delicate items may also be sent by post by arrangement with the prizewinner, but the Organiser accepts no responsibility for any damage caused during the sending of the parcel. In the event of a lost or damaged package and/or damaged package contents, the winner is not entitled to any compensation, financial or material. Minors
In the event that the participation of minors is permitted, persons under 18 years of age must provide the Organiser with the written consent of their parents or legal guardian at the same time as providing the information referred to in 3.

paragraph 1 of this Article, and no later than the date of acceptance of the prize. The written consent is provided by the parents or legal guardians.

Payment of income tax
Income tax is calculated and paid by the prize draw organiser or. a co-organiser or sponsor providing a prize.

The value of the prizes does not constitute earned income (taxable income) under 108. Article 4 of the Income Tax Act.

Protection of information and personal data
The Organiser, as the controller of personal data, respects the privacy of the participants of each prize draw and undertakes to treat personal data obtained in the course of the prize draw with care and to protect and process it in accordance with the Personal Data Protection Act and the Personal Data Protection Regulations adopted by the Organiser.

Unless otherwise provided for by law, it will not disclose to any third party or use for any purpose other than for the sole purpose of the successful overall running of the prize draw, without the express consent of the participants in each prize draw.

In the event that the Promoter organises the prize draw jointly with a co-organiser, the co-organiser will provide the co-organiser with the list of winners. The Organiser accepts no responsibility for the proper processing and storage of the data transmitted to the Co-organiser.

If a participant in the prize draw agrees to provide data to the co-organiser, the organiser will forward all data of such users to the co-organiser after the end of the prize draw. The Organiser accepts no responsibility for the proper processing and storage of the data transmitted to the Co-organiser.

If the participant in the prize draw agrees to receive the e-newsletter of the organiser and/or co-organiser, the organiser may also forward the e-mail addresses to the co-organiser of the prize draw.

The Organiser accepts no responsibility for the protection of the data on the web pages to which certain links on the Organiser’s Websites lead, nor does it accept any liability for any errors that may occur as a result of the submission of incorrect or false data by entrants to the prize draw.

The participant of the prize draw authorises the organiser, as the controller of the personal data collection, to manage, maintain and process the personal data collection for the purposes of the prize draw in accordance with the Personal Data Protection Act until the participant’s cancellation or until the purpose of the data processing has been fulfilled (Official Gazette of the Republic of Slovenia No. 86/04 and No. 67/07).The participant of the prize draw authorises the organiser, as the controller of the personal data collection, until the participant’s cancellation or until the purpose of the data processing has been fulfilled.

Personal data in the winners’ personal data file and the purpose of their collection, processing, storage and use:
email address (for the purposes of participation in the prize draw, the prize draw and for sending written requests from the Organiser for further action in the event of eligibility for a prize);
name and surname, address and place of residence (for the purposes of identification of the winner, the draw, prize notification and notification of how to claim the prizes and for reporting to the tax authorities in accordance with the applicable tax legislation in the Republic of Slovenia);
contact telephone or GSM number (for the purposes of notification in the event of any problems with the delivery of the prize);
tax number and tax office of the prize winner (for the purpose of reporting to the tax authorities in accordance with the applicable tax legislation in the Republic of Slovenia)

During the management of personal data, each individual participant has the possibility to access, copy, copy, amend, correct, block and delete personal data in the personal data collection, in accordance with the applicable regulations.

The data is stored in computer format. Once the need to keep the data ceases or at the request of the prizewinner, the data will be deleted.

The data users are the administrator of the Website and/or the Social Media Profile and are responsible for the delivery of the prizes.

By participating in the prize draw, the participant agrees that the Organiser may send him/her free of charge general announcements related to the prize draw via e-mail or the telephone number referred to in 3. para. 8. Article 5 of these Terms and Conditions until such consent is withdrawn or until the purpose for which the contact details were stored is fulfilled.

Final and Transitional Provisions
Together with the Sweepstakes Terms and Conditions, Sweepstakes Entrants accept the terms and conditions of the Meta Community and the rules of the selected social media sites. The Organiser accepts no responsibility for non-compliance with the terms and conditions of use of the Meta Community by entrants to the Sweepstakes. The Organiser also accepts no responsibility for any consequences arising as a result of the publication of the entries on the Social Media Profile.

The Organiser reserves the right to amend and modify the terms and conditions of the prize draw if required to do so for technical or commercial reasons or for reasons on the part of the public.

The Organiser will keep participants informed of any changes and updates to the prize draw by posting on the Website and/or Facebook Profile.
